These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Bearology USA (“Bearology,” “we,” “us,” or “our”). By accessing or using our website, purchasing merchandise, or participating in any Bearology-operated experience or pop-up activation (collectively, the “Services”), you acknowledge and agree to be bound by these Terms. If you do not agree, you must refrain from using the Services.

All content appearing on the website or within our Services—including, without limitation, trademarks, logos, graphics, product designs, characters, artwork, photographs, text, audio/visual materials, layout arrangements, and digital assets—is owned by Bearology USA or its licensors and is protected by applicable copyright, trademark, and intellectual property laws in the United States and internationally.

Certain products and experiential installations offered by Bearology are produced pursuant to official licensing agreements with third-party rights holders. All such licensed merchandise and content are:

• fully authorized by the applicable rights holder;
• produced in accordance with contractual quality, safety, and design standards; and
• subject to approval processes mandated by licensors.

You are strictly prohibited from reproducing, distributing, reselling (except for personal use), modifying, or creating derivative works of any licensed or unlicensed materials without prior written authorization.

No portion of the website or Services may be copied, reproduced, republished, uploaded, posted, encoded, transmitted, or distributed in any form without our prior written consent, except as expressly permitted under applicable law for personal, non-commercial use.

You agree not to engage in any activity that:

• violates any applicable law or regulation;
• attempts to gain unauthorized access to systems or data;
• interferes with the operation or functionality of the website;
• constitutes fraudulent, abusive, or harmful behavior;
• involves impersonation or misrepresentation;
• utilizes bots, scripts, or automated tools to engage with the Services.

If account creation becomes applicable, you are responsible for maintaining the confidentiality of any login credentials and for all actions that occur under your account.

Bearology endeavors to display merchandise descriptions, colors, specifications, and other product information as accurately as reasonably possible. Variations may occur due to manufacturing processes, screen display differences, or product updates.
Products, bundles, and limited-edition items may be modified or discontinued at any time without prior notice.

All prices are listed in U.S. dollars unless otherwise noted. Bearology reserves the right to adjust prices at its sole discretion and without prior notice.

By placing an order, you authorize Bearology or its designated payment processor to charge the payment method submitted at checkout.

Bearology reserves the right, at its sole discretion, to refuse, limit, or cancel any order for reasons including—but not limited to—suspected fraud, high-risk transaction behavior, duplicate orders, unusual purchasing patterns, improper email or IP usage, or any conduct deemed inconsistent with fair use of the Services.
We may block certain email addresses, payment methods, names, or IP addresses if associated with repeated high-risk activity.

Once an order is shipped, risk of loss transfers to the carrier. Bearology is not responsible for delays, misdelivery, theft, or loss caused by carriers or by inaccurate shipping information provided by the customer.

Shipping timelines displayed at checkout are estimates only and not guaranteed.

Due to the nature of limited-edition merchandise and licensed products, all sales are final unless explicitly stated otherwise.

Requests related to damaged, defective, or incorrect items must be submitted within seven (7) days of delivery and must include photographic documentation and order information.

Approval of replacements or remedies is at Bearology’s sole discretion.

The following provisions govern all Bearology-affiliated pop-ups, activations, thematic experiences, and reservation-based events (“Experiences”).

Reservations may be required for certain Experiences. By booking a reservation, you agree to comply with all policies presented at the time of booking, on-site signage, and staff instructions.

Most Experiences are open to all ages.

However, certain locations or events may offer beverages or products containing alcohol.
Alcohol will only be served to individuals aged 21 or older who present a valid government-issued photo ID.
Bearology reserves the right to refuse alcohol service to any guest for any reason permitted under law.

8.3 Late Arrivals and No-Shows
• Reservation windows may include a limited grace period (varies by location).
• Entry for late arrivals is not guaranteed.
• Reservation fees, if applicable, are non-refundable for no-shows or late arrivals.
Rebooking is subject to availability.

Bearology reserves the right to deny entry or remove any guest for behavior that is unsafe, disruptive, unlawful, intoxicated, or otherwise detrimental to staff, other guests, or property.

No refunds will be provided in such circumstances.

Personal photography is permitted unless otherwise indicated.

Professional or commercial photography and videography require prior written approval.
By entering a Bearology Experience, you grant Bearology the right to use photographs or recordings containing your likeness for promotional purposes, unless prohibited by law.

Participation in Experiences may involve interaction with themed environments, décor, lighting, or installation elements.

By attending, you voluntarily assume all risks related to property damage, personal injury, or loss.

To the fullest extent permitted by law, Bearology disclaims liability for any injury or damage occurring at or arising from an Experience.

Certain merchandise, collaborations, or limited-edition items may be offered for sale on a pre-order basis (“Pre-Order Products”). By placing a pre-order, you acknowledge and agree to the following terms:

Pre-orders require payment in full at the time the order is placed. Payment secures your reservation for the item but does not guarantee immediate shipment.

Any estimated shipping or release dates provided for Pre-Order Products are approximate and subject to change. Production delays, licensing approvals, supply chain issues, or other external factors may affect delivery timelines.

Such delays do not constitute grounds for automatic cancellation or refund unless permitted under Section 3 below.

Customers may request cancellation of a pre-order before the item has been shipped.

Cancellation requests must be submitted promptly via the contact form or customer support email.

If the item has not yet entered the fulfillment or shipping process, Bearology may, at its sole discretion, issue a refund to the original payment method.

Once a Pre-Order Product has shipped, it is no longer eligible for cancellation.

After shipment, Pre-Order Products are non-refundable, except under the following limited circumstances:

• the item arrives defective;
  
• the item arrives damaged due to fulfillment error;
  
• an incorrect item is received.
  

Claims must be submitted within seven (7) days of delivery and must include photographs and a description of the issue.

All claims are subject to review and approval at Bearology’s sole discretion.

Exchanges for Pre-Order Products may be approved only if the product is defective or incorrect and subject to availability.

If an exchange is approved, the customer is responsible for return shipping costs, unless otherwise required by law.

Shipping fees are non-refundable.

If a pre-order is placed with in-stock items, Bearology may ship items together upon availability or in separate shipments at its discretion. Additional shipping fees may apply for multiple shipments.

Bearology reserves the right to make minor modifications to the design, packaging, or materials of Pre-Order Products if required for licensing compliance, safety standards, or manufacturing processes. Such adjustments do not qualify the order for cancellation or refund.

In rare cases, Bearology may cancel a pre-order due to manufacturing issues, licensing restrictions, or insufficient production. If this occurs, customers will receive a full refund for the canceled item, which constitutes the sole remedy.

The website may contain links to third-party websites or services. Bearology does not endorse, control, or assume responsibility for the content or practices of external websites.

To the maximum extent permitted by law:

• Bearology provides all products and Services “as is” and without warranties of any kind, express or implied;

• Bearology shall not be liable for indirect, incidental, consequential, punitive, or exemplary damages arising from use of the website or Services;

• Bearology’s total liability shall not exceed the amount paid by you for the product or service giving rise to the claim.

Some jurisdictions do not permit certain limitations, and such limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Bearology USA and its officers, employees, partners, licensors, contractors, and affiliates from any claims, damages, liabilities, expenses, or losses arising out of:

• your use of the website or Experiences;
• your violation of these Terms;
• your infringement of any intellectual property or proprietary right.

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law principles.

Bearology reserves the right to update or revise these Terms at any time. Changes become effective immediately upon posting to the website. Continued use of the Services constitutes acceptance of the revised Terms.
